What is the lawsuit about?

The lawsuit involves the drug Paxil CR®, which is manufactured and marketed by Defendant SmithKline Beecham, also known as GlaxoSmithKline, ("GSK"). The lawsuit claims that Paxil CR® tablets contained a manufacturing defect that caused some of the tablets to split apart. GSK denies all of these claims and any liability.

How do I know if I am included in the settlement?

The Third-Party Payor Class consists of third-party payors ("TPPs") in the United States and its territories (other than Medicaid, Medicare and other government healthcare programs) that purchased, paid for or reimbursed for (in whole or in part) Paxil CR® between April 1, 2002 and March 4, 2005. TPPs include insurance companies, employee benefit plans, health and welfare funds, or any other private entity that purchases, pays for, or reimburses the cost of, prescription medications for qualified persons such as insureds, members, dependants, or beneficiaries. Third-party claim administrators may also file a claim on behalf of a self-funded plan if the third-party claim administrator has legal authority and authorization from the self-funded plan to do so.

What does the Settlement provide?

If the Settlement is approved, GSK will pay a total Settlement Amount of up to $28 million to settle the claims in the lawsuit. Some of this money will be paid to TPPs that made reimbursements for Paxil CR®. Some of this money will be paid to consumers who purchased or paid for Paxil CR®. TPP Class members’ recovery will be based on their number of covered lives as of December 31, 2004. More information on the Settlement payment breakdown is available in the detailed Notice.

SUBMIT A CLAIM FORM The only way to get a payment. The deadline has passed.
EXCLUDE YOURSELF Get no payment. This is the only option that allows you to start, or remain part of any other lawsuit against the Defendants about the legal claims in this case. The deadline has passed.
OBJECT Write to the Court about why you don’t like the Settlement. The deadline has passed. Objections needed to be filed/ served by July 1, 2009.
SPEAK AT HEARING If you want to speak at the Final Approval Hearing about the Settlement, you must file a Notice of Appearance. The deadline has passed.
GO TO A HEARING The Court will hold a Final Approval Hearing on July 27, 2009 at 12:00 p.m. in Courtroom 5. July 27, 2009
DO NOTHING Get no payment. Give up your rights to be part of any other lawsuit against the Defendants about the legal claims in this case. Paxil
