What is the lawsuit about?
The lawsuit involves the drug Paxil CRŽ paid for from April 1, 2002 through March
4, 2005. Paxil CRŽ is manufactured and marketed by Defendant GSK. Plaintiffs allege
that Paxil CRŽ tablets were defective in that some of the tablets were split during
the above time period. GSK denies these claims and any liability.
How do I know if I am included in the settlement?
The Consumer Class consists of all natural persons in the United States and its
territories who purchased or paid for (in whole or in part) Paxil CRŽ between April
1, 2002 and March 4, 2005.
The Settlement provides for two types of Consumer Class Claims, as follows:
Tier One Consumer Claim:
a Consumer Class Member who attests that he or she paid for (in whole or in part)
and received (during the period between April 1, 2002 and March 4, 2005) at least
one but not more than five Paxil CRŽ tablets which were defective in that they were
split before they were removed from the container in which they were purchased ("Split
Paxil CRŽ Tablets").
Tier Two Consumer Claim:
a Consumer Class Member who attests to having paid for (in whole or in part) and
received more than five Split Paxil CRŽ Tablets during the period between April
1, 2002 and March 4, 2005.
What does the Settlement provide?
If the Settlement is approved, GSK will pay a total Settlement Amount of
up to $28 million to settle the claims in the lawsuit. Some of this money will be
paid to insurance companies and other entities that made reimbursements for Paxil
CRŽ tablets. Some of this money will be paid to consumers who purchased or paid
for Paxil CRŽ. More information on the Settlement payment breakdown is available
in the detailed Notice.
Consumer Class members' recovery will be based on the number of split Paxil CRŽ
tablets you paid for or purchased, up to $150.
Attorneys' fees, expenses, payments to Class Representatives and the costs of providing
notice and claims administration of the Settlement will also be paid from
the Settlement Accounts.
